The Australian Working Visa  Subclass 457 visa (Temporary Business Long Stay) is a temporary work visa that allows employers to sponsor overseas workers to fill nominated skilled positions. The 457 visa is currently the most common pathway of business sponsorship for overseas workers. To apply for 457 work,  visa applicant must have an employer willing to sponsor him / her as part of the visa application process. Employers must meet specific sponsorship and nomination criteria before the prospective employee can apply for an Australian Working Visa  Subclass457 visa

The Temporary Work 457 visa (commonly known as an Australian Work Permit) is valid for stays between 3 months and 4 years. This visa is used by Australian that seek to employ highly skilled personnel from overseas.

Essentially there are three steps involved in a 457 visa application of this type:

Step 1 – The business must apply for sponsorship approval

Step 2 – The business must nominate a position to be filled

Step 3 – The visa applicant must lodge a visa application

Step 1 – Standard Business Sponsorship

The sponsorship application process will involve an assessment of the business’ standing, the proposed benefit to Australia as a result of employment of the applicant and the business’s commitment to training Australian citizens and residents.

In order to be approved as a sponsor, the business will need to be able to demonstrate that:

  • It is a lawfully and actively operating business.
  • It is or will be the direct employer of the temporary business entrant.
  • The Department of Immigration and Boarder Protection (DIBP) may check that the company has a satisfactory record of compliance with immigration laws and that there is no available adverse information about the business and/or its principals.
  • The business has a strong record of, or a demonstrated commitment to employing local labour.
  • The business must demonstrate its contribution to the training of Australian workers by providing evidence of meeting the training benchmarks. These benchmarks were introduced to ensure that the employment of workers from outside Australia is not seen as an alternative to training Australian workers.
  • For the two training benchmarks, the business must also show a commitment to maintain that level of expenditure in each fiscal year for the term of approval as a sponsor.
  • The business agrees to abide by the relevant sponsorship undertakings.

Step 2 – Nomination of position to be filled 

Nomination is the process of identifying an eligible occupation in a business to be filled by a skilled overseas worker.

The purpose of the nomination process is to identify all of the following:

  • The occupation relevant to the position to be filled
  • The skills and experience required for the position
  • The market salary rate for the position and the salary rate to be paid to the prospective overseas employee
  • The name of the prospective overseas employee
  • The location where the employee will be working

For nomination to be approved, the business must meet the following requirements:

  • Nominate an eligible occupation
  • Meet minimum salary and market rates requirement
  • Meet direct employer requirements
  • Provide employment terms and conditions that meet certain requirements.

Step – 3 Visa Application 

The third and final step in the application process is the completion of the visa application on behalf of the applicant.

In order for the visa to be granted, it will need to demonstrate that the visa applicant:

  • Is sponsored by an employer to fill a nominated skilled position
  • Has skills, qualifications, experience and employment background that match those required for the position
  • Meets all necessary health and character requirements
  • Has demonstrated English language ability
  • Is eligible for any relevant licenses or registration required for the nominated position
  • Has health insurance.

MRT Review Appeal – My Immigration Help Reviews

If you have been refused an Australian visa, one of the options for a review of this decision may be to apply to the Migration Review Tribunal (MRT).

Not all decisions are ‘reviewable decisions’, but the department’s decision-maker will advise you in writing if the decision is reviewable, and what steps you can take if you want to ask for a review.

Powers of the MRT

If the MRT decides that a decision to refuse a visa was incorrect, it has the power to set the decision aside and to grant the visa application. This is relatively rare, however, and in most cases where a decision to refuse a visa was found to be incorrect, the MRT will simply set aside the decision and remit the decision back to the DIAC for reconsideration.

In making a decision with respect to the visa application, the Department must take into account the directions of the MRT.

 Types of decisions which are reviewable by the MRT

Decision reviewable by the MRT includes:

• If a visa application (other than an application for a protection visa) has been refused;

• The cancellation of a visa where the visa holder was in Australia;

• Refusal to revoke the cancellation of a visa if the person is in Australia;

• A determination on the points test for skilled migration visas, business sponsorships and nominations; and

• A determination on security bonds for bridging visas.

Time Limits

It is important to note that there are strict time limits for making applications to the MRT. The time limit will depend on the decision which is being challenged but for all decisions these time limits are relatively short. The cost of lodging an MRT application is also relatively costly, so we would recommend anyone seeking to challenge a decision to seek professional advice immediately. Furthermore, an application to the MRT can only be lodged beyond the time limit in a very limited jurisdiction to review your case.

The Process

After an application is lodged, the first stage of the process is that a member of the MRT will examine the documents to assess whether the Department has made an apparent mistake in refusing to grant the visa. You may be invited to provide written submissions to support your case. If there is no apparent mistake or reason for why the refusal should be overturned, the member will seek further information from you or initiate any research that is deemed relevant. If there is nothing to suggest the refusal was incorrectly made, the member will then move to have a hearing where the application will appear to give evidence and is able to tender any further written information or call witnesses. Following the hearing the member will make a decision on the application.
